James Howells, an IT engineer from Newport, Wales, has lost his 12-year legal fight to recover a hard drive containing 8,000 Bitcoin, worth over $770 million at current prices. The hard drive, accidentally discarded in 2013, ended up in a local landfill. Newport City Council has repeatedly denied Howells permission to search the site, citing environmental concerns.

In a recent ruling, Judge Keyser, the Circuit Commercial Judge for Wales, dismissed Howells’ case, stating it had “no realistic prospect” of success in a full trial, according to a report by the BBC. Despite the ruling, the ownership of the Bitcoin on the hard drive was not disputed, a point Howells sees as pivotal.

Speaking to Cointelegraph, Howells expressed frustration with the outcome:

“My case was not given the proper level of consideration that the value of the asset in question deserved and I feel that the UK court system in general has failed me in the fact that I have not even been given the opportunity for justice at full trial.”

Howells mined the Bitcoin in 2009, during the early days of cryptocurrency when mining was inexpensive and relatively unknown. The value of Bitcoin has skyrocketed since then, increasing by over 704,000 times since the hard drive’s disposal.

The Newport City Council has maintained its stance, arguing that excavation is not feasible due to the significant environmental risks involved. A council representative reiterated on October 11, 2024, that any search would cause “huge negative environmental impact on the surrounding area.”

Howells, however, has accused the council of environmental violations, alleging that the landfill site has been leaking harmful substances like arsenic, asbestos, and methane gases into the local environment.

Despite the dismissal of his case, Howells hinted at future plans, stating he may explore tokenization opportunities to monetize his ownership of the lost Bitcoin. His legal team continues to negotiate with the council and the court regarding the final wording of the case order.
